Adult annual assumption of risk and release

For participants age 18 or older in CIKBS tournaments and related club activities.

1. Covered activities and risks

This agreement covers participation in Central Illinois Kayak Bass Series, LLC (CIKBS) tournaments and related check-in, launch, fishing, measuring, weigh-in, awards, practice, travel within event areas, and shoreline or water activities during the 2027 season. Kayak fishing involves risks including capsizing, drowning, collision, entanglement, hooks and other sharp objects, slippery or uneven surfaces, submerged hazards, moving water, weather, lightning, heat or cold exposure, wildlife, motor or battery failure, traffic, delayed rescue or medical care, theft, and property damage. These risks may cause serious injury, illness, permanent disability, death, or property loss.

2. Voluntary participation and safety

I choose to participate and am responsible for deciding whether conditions, my health, skill, equipment, and experience are suitable. I will follow applicable law and CIKBS rules; wear a properly fitted, approved wearable personal flotation device whenever afloat; use safe equipment; monitor weather and water conditions; obey officials; and stop when conditions exceed my ability. I understand CIKBS does not guarantee safety, rescue, medical care, water conditions, or the acts of other people.

3. Assumption of risk; release and covenant not to sue

Released Parties means CIKBS; its members, managers, officers, employees, volunteers, officials, judges, scorekeepers, contractors, agents, sponsors, and representatives; and, when involved in a Covered Activity, host sites, launch owners or operators, landowners, lessors, governmental entities, and each of their personnel, successors, and assigns.

To the fullest extent permitted by Illinois law, I release and forever discharge the Released Parties from claims, demands, damages, losses, liabilities, and causes of action for personal injury, death, or property damage arising from or relating to a Covered Activity, including claims alleging the ordinary negligence of a Released Party. I covenant not to sue a Released Party on a released claim. This release does not apply to gross negligence, willful and wanton or intentional misconduct, or any duty or liability that cannot lawfully be released.

I knowingly and voluntarily assume all risks of the covered activities, including serious injury, drowning, death, property loss, and risks arising from the ordinary negligence of a Released Party.

4. Emergency response, property, and conduct

If I am injured or unable to act, I authorize reasonable first aid, emergency contact, information sharing, rescue, and transport. I am responsible for resulting charges not otherwise covered. I am responsible for my kayak, vehicle, electronics, tackle, batteries, and other property, and for loss or injury caused by my own conduct or equipment.

5. Term, law, and electronic acceptance

This agreement applies for the 2027 season and may be revoked only for future activities by written notice received by CIKBS. Illinois law governs. If any provision is unenforceable, it will be narrowed or severed and the remainder will continue. I agree that a website checkbox, typed name, timestamp, and associated electronic record may constitute my electronic signature and may be retained as proof of acceptance.

Parent/guardian consent and minor risk acknowledgment

For each participant under age 18. This is not a waiver of rights Illinois law does not allow a parent to release.

1. Consent and acknowledgment of risks

I am the minor's parent or legal guardian and authorize the minor to participate in CIKBS tournaments and related activities described on this form. I understand that kayak fishing involves risks including capsizing, drowning, collision, entanglement, hooks, slips and falls, submerged hazards, weather, lightning, heat or cold exposure, wildlife, equipment failure, traffic, delayed rescue or medical care, serious injury, permanent disability, death, and property loss.

I understand these risks, voluntarily consent to the minor's participation, and accept responsibility for deciding whether the minor's health, skill, equipment, and experience are suitable.

2. Safety and supervision

The minor will follow applicable law and CIKBS rules; wear a properly fitted, approved wearable personal flotation device whenever afloat; use safe equipment; obey officials and safety instructions; and stop when conditions exceed the minor's ability. I understand CIKBS does not act as a guardian or provide continuous supervision and may remove the minor from an activity for safety, rule, conduct, permit, or insurance reasons.

3. Emergency medical authorization

If I cannot be reached promptly, I authorize CIKBS personnel, emergency responders, and medical providers to give reasonable first aid; contact emergency services; share information reasonably necessary for care; arrange rescue and transport; and provide evaluation or treatment reasonably believed necessary. I accept responsibility for medical, rescue, and transport charges not otherwise covered.

4. Parent/guardian's own claims

To the fullest extent permitted by Illinois law, I release the Released Parties identified in the adult waiver from claims that belong to me individually or derivatively, including legally waivable claims for medical expenses, loss of services, or other loss I incur arising from the minor's participation, including claims alleging ordinary negligence. This paragraph does not claim to release the minor's own injury claim where Illinois law does not permit me to do so. It does not apply to gross negligence, willful and wanton or intentional misconduct, or other liability that cannot lawfully be released.

Minor participant acknowledgment

I have read this form or had it explained to me. I understand that kayak fishing has serious risks. I agree to wear my PFD, follow the rules and safety instructions, tell an adult if I feel unsafe or unwell, and stop when conditions exceed my ability.

Acknowledgment and signature

The final online flow will require a separate affirmative acknowledgment, typed legal name, date and time, document version, and electronic acceptance record. Minor accounts will also require the parent or legal guardian's acceptance and the minor participant's assent.
